It's been almost three years since the Covid lockdown, and many aggrieved parents have filed a petition from around the state seeking relief from fees imposed by Uttar Pradesh schools during the Covid Period (2020-2021).While hearing the petition, the Allahabad High Court on Monday gave the directions and said, "15% fees that the schools charged should be adjusted in fees to be paid in future semesters." Now the court has given a time of two months to all the Uttar Pradesh schools to calculate and implement the procedure.

All the schools across the state now have to adhere to the 15% ratio of the total fees charged during the Covid era and adjust it in future semesters. The court stated that students who have dropped out of school would refund their payments to their parents. On January 6, a division bench comprising Chief Justice Rajesh Bindal and Justice JJ Munir heard the public interest litigation filed by petitioner Adarsh Bhushan and other petitioners.Petitioner's lawyer argued that the fee is a question of quid pro quo (legal maxim), meaning; a benefit received in exchange for another benefit. According to the petitioner's lawyer, charging even a single rupee above the tuition fee charged by private schools is nothing more than profiteering and the commercialization of education because, during 2020-2021, private schools only provided online tuition as a service. To further strengthen their argument, the petitioners' lawyer quoted the recent judgment given by the Supreme Court in India School, Jodhpur, and another Vs. State of Rajasthan and others (2021). The apex court stated that the private schools asking for school fees during the Covid era, even though they were not providing any services, are making the education institutions commercialized.

The petitioners submitted their plea citing their concern that during the pandemic, the school demanded fees and other costs from the children enrolled in numerous school curricula. The state government occasionally issued new directives that the schools were obliged to abide by.The central crux of the petitioner's concern was that schools were not providing the physical mode of education at that time neither their children attended the schools physically nor utilized any facilities of the school premises, which shouldn't allow the school authorities to ask for the same amount of fee that they used to give during the period before covid, i.e., 2019-2020.Do visit our website for more news, facts, and article where we share The True Stories of The World, The TopStoriesWorld.Com
