'Free Speech Should Not Be Transformed into Hate Speech', says Madras HC amid Sanatana Dharma Controversy

Amid the ongoing debate surrounding Sanatana Dharma, the Madras High Court has emphasized that while free speech is essential, it should not be transformed into hate speech.


The court further said that Sanatana Dharma is a set of eternal duties, including duty to the nation, to the King, to one's parents and gurus, and care for the poor, among others.


While sitting over a petition opposing a circular from a local government Arts College asking students to explore "Opposition to Sanathana," Justice N Seshasayee voiced worry over the heated disputes surrounding Sanatana Dharma. He disagreed with the view that Sanatana Dharma is primarily concerned with maintaining social hierarchies based on caste and status.

Madras High Court emphasizes the importance of responsible free speech and rejects hate speech in the Sanatana Dharma debate


“While free speech is a fundamental right, it should not devolve into hate speech, particularly when it pertains to matters of religion,” the Judge said.


The court's comments are a rebuttal to those of Tamil Nadu Minister Udhayanidhi Stalin, who drew criticism for likening Sanatana Dharma to "dengue and malaria." The statement by the court condemns discrimination based on one's caste and illuminates the inclusive essence of Sanatana Dharma.
