Opposition Parties To Face Legal Action Over Use of ‘INDIA’ in Alliance Formation

New Delhi, July 19, 2023: A police complaint has been registered against 26 opposition parties at Barakhamba Police Station in Delhi for their alleged improper use of the term 'INDIA' and its potential impact on elections, according to reports from news agency ANI.

The complainant, Dr Avinish Mishra, expressed objection to the name of the alliance and called for necessary action against the parties. Mishra argued that the term 'INDIA' has been misused for undue influence and personation during elections, which has hurt the sentiments of the people. "26 political parties have misused the name of the country," read the complaint.

The case has been filed under Section 2(c) of the Emblems Act, which defines "name" to include any abbreviation of a name. As per Section 5 of the Emblems Act, contravening provisions of Section 3 can result in a fine of ₹500.

In a separate complaint, Maharashtra BJP leader Ashutosh Dube also approached the Election Commission, alleging that the use of 'INDIA' by the opposition parties for political gains disrespects the dignity of the country. Dube urged the commission to intervene in the matter to maintain the nation's dignity and uphold democratic principles.

The 26 opposition parties recently formed a coalition called 'INDIA' (Indian National Developmental Inclusive Alliance) with the aim of challenging the ruling Bharatiya Janata Party (BJP) in the upcoming Lok Sabha elections. Congress leader Rahul Gandhi emphasized that the fight would be "between INDIA and Prime Minister Narendra Modi."

The alliance released a declaration titled 'Samuhik Sankalp,' addressing various issues such as caste census, Manipur violence, the role of Governors and Lieutenant Governors, and demonetization.

During their meetings, the parties agreed to establish an 11-member coordination committee, with decisions regarding its members and convener to be made at the next gathering in Mumbai. The first meeting took place in Patna, Bihar, which is governed by parties affiliated with the INDIA front. The second meeting was held in Bengaluru, Karnataka, where the Congress recently regained power.

The 26 opposition parties involved in the alliance are Congress, TMC, DMK, AAP, JD(U), RJD, JMM, NCP (Sharad Pawar), Shiv Sena (UBT), SP, NC, PDP, CPI(M), CPI, RLD, MDMK, Kongunadu Makkal Desia Katchi (KMDK), VCK, RSP, CPI-ML (Liberation), Forward Bloc, IUML, Kerala Congress (Joseph), Kerala Congress (Mani), Apna Dal (Kamerawadi), and the Manithaneya Makkal Katchi (MMK).
