Bhayander Man Acquitted in Teen Daughter's Molestation Case by Thane Sessions Court

In a recent verdict, the Thane sessions court has acquitted a 52-year-old man from Bhayander who was facing charges of molesting and sexually abusing his teenage daughter. The presiding Judge D S Deshmkuh, in a decision issued earlier this month, highlighted the prosecution's failure to substantiate the allegations.
The daughter filed a complaint against her father when she was 14 years old, accusing him of making unwanted physical and sexual attempts towards her while under the influence of alcohol. In addition, she said he had sexually harassed her.
After hearing about what had happened, the teen's mother filed a report with the Navghar police. Two minor offences were filed against the father, who is currently working in the Gulf. The man was arrested on molestation charges under the Protection of Children from Sexual Offences Act and the Indian Penal Code. After that, bail was set at $100,000.
The defence attorney testified at trial that the claims were completely false. The defence further claimed that an ongoing marital quarrel between the pair "motivated" the filing of the First Information Report (FIR).
Judge D S Deshmkuh agreed with the defense's argument that there was a lack of evidence to back up the prosecution's case against the defendant, and he ruled accordingly. The prosecution couldn't prove its case beyond a reasonable doubt, thus their argument collapsed.
