The Supreme Court (SC) on Monday directed Attorney General R Venkataramani and Solicitor General Tushar Mehta to look into the suspension of Zahoor Bhat, a lecturer in the Jammu and Kashmir education department, after he appeared as a petitioner in a case challenging the validity of the abrogation of Article 370 in 2019. 



Bhat, a legal professional with a law degree, personally appeared before the Constitution bench on August 23 to challenge the manner in which Article 370 was nullified, stripping Jammu and Kashmir of its semi-autonomous status. However, news emerged that he was suspended from his position by the Jammu and Kashmir administration soon after arguing before the top court.


During the Supreme Court's hearing, senior advocates Kapil Sibal and Rajeev Dhavan highlighted Bhat's suspension, pointing out that he was put on leave for two days to argue his case before the court, only to be suspended upon his return. 


The five-judge bench, led by Chief Justice D Y Chandrachud, expressed concern over the situation and requested Venkataramani to discuss the issue with the Jammu and Kashmir Lieutenant Governor.


Attorney General Venkataramani stated that he would investigate the matter further. Solicitor General Mehta clarified that the lecturer's suspension was attributed to several factors, including his frequent petitions filed before various courts. Mehta offered to present all related materials to the court if necessary.


Kapil Sibal countered by questioning the timing of the suspension, asserting that Bhat had been active in legal matters previously, making the sudden suspension after his appearance before the Supreme Court seem unfair and undemocratic.


The top court bench emphasized that if there were any other reasons which led to the suspension of the lecturer then it needs to be looked into.
