MMRDA Received Remark on Their Eviction Notice By HC:-
News: Bombay High court rebuked Mumbai Metropolitan Region Development Authority (MMRDA) for giving 48 hour eviction notice to the residents of Mumbai. The court further took a note that the MMRDA authority should alternatively accommodate the individuals at ‘Taj Hotel’. Instructions were set for the hotel as well.   The court, however, has pulled up MMRDA that the petitioners have restored to beggary due to lack of other options of accommodation.  MMRDA Received Remark on Their Eviction Notice By HC MMRDA Received Remark on Their Eviction Notice By HC Court’s remark on the petition filed as against the alternative accommodation; What is the petitioner supposed to do, beg near Flora Fountain? If you cannot give him alternate accommodation, then put him up at the Taj (hotel). He will stay there,"   “And when I say the Taj hotel, I am talking about the old Taj hotel.”, the division bench headed by Justice GS Patel further added.  The seven star ‘Taj Hotel’ at Mumbai’s gateway of India has two divisions; one is the old heritage building and the other is newer one. The old building is considered to be more structured and fancier than the new one.  Proceedings on petition filed by Singh  The petition filed by one of the resident of Mumbai, Shobhnath Singh on February 8th, 2023 challenged notice issued by the MMRDA authority. However, the division bench of court did not specified any hearing while considering the petition in the proceedings.   The notice contained eviction order to either vacate the premises with his family/friends or will be forcibly thrown out. During the court proceedings, the petitioner claimed that he did have any alternate accommodation for living and dispossession forcibly is a threat. Singh considered the notice an unreasonable order.  Further, the petitioner also said that he along with his family was locked up in the unit where he was previously residing , when the MMRDA authority found about the petition, he filed in the court. The division bench questioned the issue of short notice, without availing any alternate accommodation. Singh stated that his present house is his only accommodation.  Advocate Aparna Patkar, the presenting lawyer of MMRDA contented that Singh was not allotted the flat where he was residing with his family. Also, he had given an undertaking to the MMRDA to vacant the premises by Feburary 13.  Patkar further explains that the flat was granted to project related persons for rehabilitation, and Singh wasn’t a part of the project.  MMRDA Received Remark on Their Eviction Notice By HC MMRDA Received Remark on Their Eviction Notice By HC Hence, the notice of eviction was issued to him.  Conclusion  The court, however has asked MMRDA to file the response by March 10.
