Delhi HC Steps in To Protect Dignity and Privacy of Aishwarya Rai’s Daughter, Aaradhya

Justice C Hari Shankar on the presiding Delhi High Court bench in a matter relating to the privacy rights of Aaradhya Bachchan took a protective decision today (20th April 2023). At the heart of the Court’s judgment, lay the message that all children, be it the child of a commoner or be it a Starkid, must be treated with dignity and respect and must be given reasonable privacy for overall holistic development as a matter of fundamental right.

Who is Aaradhya Bacchan?

Aaradhya Bachchan is the daughter of Aishwarya Rai Bachchan and Abhishek Bachchan and the granddaughter of Big B Amitabh Bachchan. Currently, Aaradhya is of the tender age of 11 years and she has become the center of gossip and discussion in many online public forums which take interest in the lives of celebrities and the Bollywood in general.

Factual Background of The Case

A few channels on YouTube which is a video streaming platform owned by Google were found to propagate perverse and misleading information regarding Aaradhya’s mental and physical health. The information shared amounted to defamation and caused harm to the goodwill and privacy of the entire Bachchan family.

The Court said, “On the plaintiff bringing to their notice any other videos uploaded on its platform dealing with physical health and wellbeing of the plaintiff, Google will take immediate steps to take those down.”

The Court’s Order

The Court has ordered Google to remove access from videos that shared problematic content about the Bachchan family. It also ordered Google to disclose the identities of the defendants. Further, Google was ordered to submit a report to the Court describing the policies it had undertaken to comply with the IT Rules. The Court’s reasoning read, “Every child is entitled to be treated with honor and respect whether he/she is the child of a celebrity or a commoner. Circulating information with respect to the mental and physical health of a child is completely impermissible in law.”
