Biden-led Democratic Party Came Up with New Asylum Rules; Critics Compared It to The "Transit Ban

 New Asylum Rules:-

The conflict in the South for the USA with its neighbors Mexico runs back to the 1800s when Mexico became independent of the Spanish colonies. From expanding its border toward the South and taking in states such as California, Nevada, and Utah under its control from Mexican rule, to the recent immigrant dispute, the US has a vast history with its southern neighbors. In a new set of events, the Biden administration last week released new asylum rules that would put stiff restrictions on asylum seekers from entering the US from the Southern borders with Mexico.  New Asylum Rules The rule states that any person would be denied asylum in the United States if they didn't first seek asylum in the countries they passed through on their way to the US-Mexico borders.  The people seeking asylum would need to use the Customs and Border Protection’s “CBP One” smartphone app. The app should be used to schedule "asylum application appointments" at official border crossings.  As per officials from the government, CBP One would become the main channel for initiating most asylum requests. The draft, referred to as the “rebuttable presumption of asylum ineligibility,” has some exemptions for asylum seekers. The new asylum rules do not apply to:

• Unaccompanied children 
• Migrants using the CBP One app beforehand for booking slots.
• Migrants who can prove that they face the risk of a “medical emergency,” are a “victim of a severe form of trafficking in persons,” or face “an imminent and extreme threat to life or safety.”
• Migrants who can prove that the CBP One app is "inaccessible" or "unusable."
• Migrants who can prove they failed to receive asylum in Mexico and other countries as they passed through before reaching the borders.

It is believed that the new rules will come into effect after the "expiration of a Pandemic-Era Restriction," or Title 42 on May 11, 2023. The rules, however, are considered by many as an effort to bar asylum seekers from entering the US. The new asylum rules are also compared with the "Transit ban" proposed by the Trump administration in 2019. Laurie Ball Cooper, U.S. legal services director at the International Refugee Assistance Project, opined that the rules are a clear mimic of the previous government. He said, “Instead of reversing the previous administration’s cruel attacks on the immigration system, the Biden administration is now leading its own shameful assault on refugees seeking safety.”  Kimiko Hirota, a policy adviser at the Women’s Refugee Commission, lashed out at the rules and called it “a slap in the face to families seeking safety and to U.S. and international law.” Nevertheless, the Biden administration rejected all the claims comparing the rules to the "Transit ban" and underlined it as a way to promote a "safe and legal pathway" for securing asylum in the States. With the undocumented crossing at the US-Mexico border reaching a record high in 2022, the notion behind the proposed rules is comprehensible. Whether the proposal will completely stop the asylum seekers from entering the US or ensure safe passage of the immigrants; remains to be seen.
